the Deputy Chief Justice Nancy Baraza. Security guard Rebecca Kerubo Morara claims she was intimidated with a pistol by Baraza when she sought to frisk her on New Year’s Eve. Baraza accepts there was a dispute but denies threatening the guard with a gun. Morara recorded a statement at Gigiri Police Station in the Occurrence Book reference OB 14/1/1/2012.

According to the report, Baraza drove into the shopping mall after 5pm and parked her car about 50 metres from the point where shoppers are frisked before entering the mall. She then walked past the desk clearly marked Security Check where other customers were queueing.

The police are reviewing CCTV footage of the incident. On the footage a female guard follows Baraza into the mall and speaks to her before she enters a pharmacy about 30 metres from the entrance. Thirty minutes later Baraza reportedly walks back to the security desk where she pauses briefly before walking back to her car. She comes back holding “something” in her hand and is seen confronting the female guard who goes on her knees at around 6.18pm on the CCTV.

Yesterday, Police Commissioner Mathew Iteere said he was aware of the incident and had instructed his officers to investigate. “I cannot give any more details as the officers are yet to brief me,” he said. Yesterday, the Deputy CJ denied drawing a gun but described the incident as “unfortunate”. “I walked into the chemist in a hurry and I did not realise that this lady was conducting security checks. But instead of talking to me with a little courtesy, she was shouting insults at me even as I tried to calm her down. I explained to her that I was a law-abiding citizen but with armed security detail. I said that if she continued to shout at me, my security detail would intervene and indeed my security intervened. My security had a gun and no one flashed or pointed a gun at her,” Baraza said.

“This was a very unfortunate incident and maybe I should have just stuck to my usual security arrangements which demand that I never walk alone. But you know we are all human and sometimes you just want to be ordinary. I have shopped in that chemist for many years,” Baraza said. “I was not defying the security arrangements put in place at that place but the lady could not listen to me and was instead shouting and embarrassing me. The allegation that I pinched her nose is wrong. I only touched her face as she tried to grab me,” explained Baraza.

Shopping malls and commercial buildings in Nairobi tightened up their security checks last year after al Shabaab threatened revenge attacks for the KDF incursion into southern Somalia. The initial report indicated that the female guard was manning the Village Market entrance with her male colleague when the Deputy CJ and her bodyguard drove in. The female guard was frisking customers when a woman walked quickly past the queue. The guard requested that the woman complies with the search and claimed that she did not recognise Baraza.

According to Morara’s statement, the Deputy CJ pinched her nose and told her to “know people” before she walked past her to the pharmacy. On her way back, the Deputy CJ warned that she could order her bodyguard to shoot Morara. Morara claims that Baraza then went to her car and came back brandishing a pistol. She says that she (Morara) went on her knees pleading for her life.

The shaken guard reported the incident to her supervisor after Baraza left. She then reported to Gigiri Police station and was summoned back on Monday afternoon. Gigiri OCS Hassan Bwego yesterday spent the day at Village Market with security officers watching the CCTV footage. He was joined in the afternoon by the OCPD Josek Nasio.

Morara told the Star, “I was frisking customers who were queueing when I noticed a woman walk past without being searched. I followed her to request that she comply with the mandatory search. I did not recognise her and pleaded with her telling her it was mandatory that all clients are searched because of the security situation. She pinched my nose hard and told me to know people and then walked into the pharmacy.” Morara said the woman later informed her she was the Deputy Chief Justice.

Morara added, “The lady walked to her car and came back brandishing a pistol threatening to kill me. I went on my knees and pleaded with her to spare my life. I was very scared because my father was shot dead in a similar situation. I don’t think I want to work as a guard after that experience”.

    madam Baraza,respect your post.i thought a deputy cj should set a good example to the entire community.the word shame is not enough ,that was foolish.the guard was just doing her work.

    Something doesnot make sense in this whole reporting. Has anyone seen the cctv footage? Cameras dont lie, unless they were not working like wanjirus case!

    cammon Nancy you took the oath to put justice in place look at you, don’t bring tantrums in the republic, Do you expect everyone to know who you are? in any case regardless of whoever you are you should follow guidelines of other places and follow you want all of us to follow the rules but you want to break others rules, wake up thats a very big draw back its a let down to all who thought you are capable of your work . That has followed in line of you duty, pure let down

    Ukweli usemwe. Nchi tuipendayo ya Kenya imegawanywa katika vikundi tofauti kulingana na uwezo wa huyu na yule. Maana yake ni tangu jadi, Kenya imegawanywa katika vikundi vya wale matajiri, wale waliosoma na wanapata ajira na mapato makundi kutoka kwa waajiri wao, wale ambao ni wanapata mapato ya kadri lakini hawawezi kupiga hatua kubwa kujiboresha kiuchumi, na mwisho maskini.

    Lakini kuna kikundi ambacho ni cha sampuli spesheli ambao ndio wanaoimiliki Kenya nzima, na wafanyacho chochote kiwe kinyume cha sheria kiasi gani, hawaguswi hawagusiki. Hio ni bahati yao. Na ni bahati ambayo wameisherehekea tangu ITHAVETHI alipokuwa kijana kijana miongo kadhaa iliopita. Diposa wakati mwingine nadodokwa na machozi nikikumbuka jinsi nilivyogonja utawala wa Rais Moi uporomoke baada ya miaka ishirini na minne ya “Kufuata Nyayo” nikidhania mambo yatabadirishwa na viongozi wapya, kumbe muziki ni ule ule miaka minane baadaye. Naibu huyu ambaye anaelewa wazi wazi kwamba nchi ya Kenya imetenganishwa kwa vikundi vya wenye mapato madogo na makubwa, wadhifa mdogo na mkubwa, wenye kufaa viatu vya ngozi na vya tairi, yungali na kasumba kwamba hawezi piga foleni kama wengine. Ni desturi ambayo viongozi na wenye nyadhifa kubwa katika jamii wamening’inia nayo tangu miaka ya sabini. Ni ugonjwa kama ule wa kujikuna kuna mapacha wakati wa mvua ya mpito.

    Binti huyu ambaye tunamtegemea kuitekeleza katiba mpya ndiye sasa ameanza kuonyesha upuuzi wa Wakenya wa kimo kidogo. Kumjadili Binti Baraza sio kupoteza wakati. Kumsengenya Binti Baraza sio kinyume cha sheria kama wenzake katika Koti Kuu watakavyo tufikiria. Haiba ya Binti Baraza inatuacha na maswali mengi ya kana kwamba atakuwa na uwezo kikamilifu wakuaminiwa na Wakenya kutendaya umma haki kama hawazi piga foleni na kupekuliwa pekuliwa kama wananchi wa kawaida. Kwani yeye ni nani? Si mwanamke kama wanawake wanyenyekevu niwajuao? Anatakiwa atafute kazi kazi hapa kwenye vichumba vya wazee wazee ili afunzwe taaluma ya kunyenyekea, kustahimili, vumila na subira. Bure kabisa!

    Binti Baraza ni Mkenya ambaye amebahatika. Yeye ni mtumishi wa serikali wa jadi. Pia amesoma na mwisho yeye ni baadhi ya Wakenya wa kwanza ambao tayari wamenufaika na kufaidika kutokana na katiba mpya. Amepawa kazi ya wadhifa mkubwa kiasi kwamba yeye ni Naibu wa Hakimu Mkuu wa Kenya. Yaani akikohoa, akitamka lolote…unakuwa uamuzi na hukumu ya mwisho, lakini tu kwa Mkenya mdogo kama ITHAVETHI. Wengine ni wale hawaguswi hawagusiki, hawashitakiwa hawahukumiwi. Na yeye ni mmoja ya wale hawagusiki wala kupapaswa na kupekuliwa pekuliwa na maofisa wa usalama.

    Eti kwa Binti Baraza kupiga foleni kama wengine ni marufuku. Eti tena taaluma ya kunyeyekea na subira imemponyoka kwa kasi Binti Baraza. Machowe hioni wananchi wadogo wakipiga foleni huku wakingojea huduma. Kama huo si unafiki, madharao na upuuzi kwa wananchi wadogo ambao wamekuwa wakipanga foleni sijui tena tuitaje. Tatizo hili la Wakenya kuachana kwa mapato na dhifa ni tatizo ambalo limejichimbia mizizi miango kadhaa iliopita. Lakini cha kuchukiza ni kwamba visanga kama hivyo Binti Baraza alivyoonyesha ni ugonjwa ambao umeenea kwa Wakenya maarufu ambao wanafikiria dhifa walizonazo zinamfaidi Mkenya wa kawaida.     I just pray that this poor mother of three will not end up rotting in jail coz of that incident. She was purely doing her work that she is paid to do. If indeed the DCJ wanted to be ordinary as she puts it, then she should have adhered to what the ordinary do – que and be checked by the security personnel instead of just bypassing the que and expect that this lady would recognize her. It is good to lead by example.

    Lakini kuna kikundi ambacho ni cha sampuli spesheli na aina ya kipekee na ambao ndio wanaoimiliki Kenya nzima, na chochote wafanyacho hata kiwe ni kinyume cha sheria,hawaguswi hawagisiki. Na hio imekuwa bahati kwao. Na ni bahati ambayo wameisherekea tangu ITHAVETHI alipokuwa kijana chipukizi na machachari miongo kadhaa iliopita. Diposa wakati mwingine nadodokwa na machozi ninapokumbuka jinsi nilivyongoja utawala wa serikali ya KANU uporomoke baada ya kulazimishwa kuzifuata “Nyayo” zilizonielekeza patupu. Nikawa na matumaini baadaye kuwa viongozi waliomo sasa watayabadirisha mambo. Kumbe muziki wa magoma ni ule ule! Tukadhulumiwa kwa vitendo vya hujuma, dhiki, unyama, uporaji na kulemazwa. Na Binti Nancy Baraza ayajua hayo yote.

    Yeye ni baadhi ya hao Wakenya wenye hadhi ambao hawaguswi hawagusiki, huwapapasi wakapapasika, na hawashitakiwi wakashitakika. Binti Baraza sio mwananchi wa kawaida kama anavyodhani. Yeye ni Naibu wa Hakimu Mkuu aliyesajiriwa na katiba mpya. Naibu huyu anaelewa wazi wazi kwamba yeye yuko katika kikundi cha kijamii ambacho kupiga foleni kama wengine sio dharao wala kinyume cha sheria. Anaelewa kwamba wapigao foleni ni wale wavaao viatu vya tairi. lakini wavaao vile vya ngozi kutoka Uhispania na Uingereza……la hasha! Ni kasumba ili na wengi na imebadilika kuwa desturi. Wamening’inia nayo tangu miaka ya sabini. Ni ugonjwa kama ule wa kujikuna kuna mapacha wakati wa mvua wa mpito.

    Binti Baraza, ambaye tunamtegemea kuitekeleza katiba mpya kwa Wakenya wote bila mapendeleo, ndio sasa tunamuona. Kumjadili binti huyu sio kupoteza wakati. Kumsengenya binti huyu sio kinyume cha sheria kama wenzake katika koti kuu wanavyodhania. Haiba ya Binti baraza inatuacha na maswali mengi ya kana kwamba atakuwa na uwezo kikamilifu wakuaminiwa na Wakenya kuwatendea haki kama hawezi panga foleni na kupekuliwa pekuliwa na maofisa wa usalama kama wananchi wa kawaida. Kwani yeye ni nani? Si ni mwanamke kama wanawake wanyenyekevu niwajuao?

    Anatakiwa aje hapa Marekani atafutiwe kazi katika vyumba vya wazee wazee na wenda wazimu ili ajifunze taaluma ya kunyenyekea, kustahimili, vumila na subira. Nitamlipia nauli ya ndege. Bure kabisa.
